Hacking in reference to Tivo does not mean stealing. Hacking in reference to Tivo means expanding the functionality, and is in fact encouraged by Tivo.
We're not talking about the subscription service here. We're talking about taking a legitimately purchased piece of hardware and convincing it to do something specific with a non-standard piece of video input.
